The State of eDiscovery 2026: Market Insights, Staffing Pressures, and Winning Strategies

September 11, 2026•4 min read

Year after year, digital evidence collection expands for legal and compliance departments. At the heart of this expansion is eDiscovery software, which enables organizations to gather, evaluate, and deliver records under strict time constraints. Although the industry for these solutions continues to broaden, market expansion only reveals part of the picture.

The execution of discovery work is being fundamentally transformed by talent shortages, evolving regulatory priorities, and increased reliance on automated processes. This overview examines recent 2026 eDiscovery data and details the key implications for forward-thinking legal and compliance professionals.

Continued Market Expansion Amid Restrictive Budgets

Despite widespread stagnation in legal budgets, the global eDiscovery software market maintained its upward trajectory into 2026. Valued at approximately $18.73 billion in 2025, the market expanded to nearly $20.74 billion in 2026. Industry projections indicate it will reach $46.06 billion by 2034. North America remained the dominant regional market, representing almost 40% of overall demand in 2025.

Cloud delivery model adoption has accelerated, with cloud deployment accounting for more than 75% of total eDiscovery spending in 2026 as legal practitioners increasingly embrace cloud-based solutions as the industry standard. Within the broader market, the software segment alone is anticipated to reach around $7.27 billion in 2026 and project forward to nearly $9.06 billion by 2028, reflecting an annual growth rate of roughly 11.4%.

Analysts point to rising volumes of electronically stored information, faster adoption of cloud-based deployment, and deeper integration of AI and machine learning into review work as the main drivers behind this growth. A few forces stand out:

  • Rising volumes of electronically stored information across industries

  • Faster adoption of cloud-based deployment models

  • Deeper integration of AI and machine learning into review work

  • Continued growth in litigation and regulatory investigations

The Staffing Squeeze Behind Every Discovery Deadline

Talent shortages are colliding with rising data volumes across the legal industry. Lawyers posted an unemployment rate of just 1.0% in the first quarter of 2026. Paralegals and legal assistants saw 3.6% in the same period. Both figures sit well below the national unemployment rate. Sixty-one percent of legal leaders said finding skilled professionals had grown harder over the past year.

Competition is especially intense for candidates who combine legal knowledge with technology skills. CLOC's 2026 industry report found demand rising fastest in regulatory compliance and cybersecurity. Yet only 32% of legal departments expect to add attorney headcount.

That gap between rising workload and flat staffing shows up directly inside eDiscovery software teams. A 2026 survey of more than 100 legal professionals found document management, review, and reduction cited by 58% of professionals as the top firm-level eDiscovery challenge. Other top challenges included:

  • Data collection: 34%

  • Coordinating collections with clients: 31%

  • Building chronologies and timelines: 28%

This workload becomes even more challenging with the integration of mobile and messaging data.

Regulators Keep Raising the Stakes for Mobile Data

Mobile communications remain a top enforcement target for financial regulators. The SEC and FINRA have collected more than $3.5 billion in combined fines for off-channel communications failures since 2021. In January 2025, the SEC settled with twelve financial firms over failures to preserve electronic communications. Combined penalties reached more than $63 million.

FINRA kept pursuing cases even as SEC activity slowed in 2025. Velox Clearing was fined $1.3 million by FINRA and $500,000 by the SEC in mid-2025. More than 10,000 messages had gone unretained despite an internal compliance flag. Early in 2026, FINRA barred an individual entirely from associating with member firms over off-channel communications use. That shift signals regulators are now willing to hold individuals personally accountable, not just firms.

How Automation Is Reshaping eDiscovery Software Economics

Automation does more than accelerate workflows, it fundamentally redirects how discovery funds are allocated. According to industry modeling, the share of overall eDiscovery task expenditure on document reviews has steadily declined, dropping from 73% in 2012 to approximately 62% in 2025. This share is anticipated to decrease even further, reaching nearly 52% by 2030.

This shifting workload is increasingly absorbed by automated processing and AI-assisted review tools. Valued at $334 million in 2025, the AI segment of eDiscovery is projected to expand at a compound annual growth rate of 16.1% through 2030, climbing to roughly $733 million.

Rather than eliminating the demands introduced by mobile data, these advancements shift the operational focus away from manual downstream review and toward intelligent, targeted collections upfront.

Building a Defensible eDiscovery Strategy for Mobile Evidence

In modern legal and regulatory cases, mobile chat data and messaging records have become central evidence. Traditional mobile forensic tools, however, were not designed to handle today’s data volumes or withstand modern regulatory scrutiny. We created PME to address this challenge by providing targeted, remote collection of text messages and application data across Android and iOS devices.

By enabling compliance and legal teams to precisely scope collections by date range, custodian, and specific data types, our platform eliminates the need for physical device shipping or onsite technician visits. This targeted approach minimizes time spent reviewing non-relevant material, while built-in workflows deliver the detailed chain-of-custody documentation required by regulators during enforcement actions and examinations.

With regulatory enforcement increasing and resources remaining constrained, securing an efficient and defensible mobile collection workflow is essential. Request a demo to learn how our targeted collection capabilities can support your upcoming investigations.
